The Jharkhand High Court on Friday evening directed to issue a bailable warrant against builder Vijay Kumar Sahu of VKS Reality for not appearing in court in person.
The bench of Justice Rajesh Shankar instructed the Officer in- charge of Argora police station to execute this and also stated that the builder be released on furnishing a personal bond of Rs 50,000 and also to ensure his physical presence on the next hearing scheduled for January 10.
The court said that in the light of the order issued on November 22, 2024 neither the builder is physically present nor has an application been filed seeking exemption from physical appearance. However, other defendants including Ashok Kumar Walamji Parmar, Jay Parmar and Jeet Parmar were present before the court and for the next hearing the builder has been directed to be present in person. Advocate Sumit Garodia argued on behalf of the applicant.
The petition was filed by the residents of Ratan Heights Society in Morhabadi under Bariatu police station stating that after the builder VKS Reality dug a 35- feet deep pit adjacent to the land of the said apartment on Morhabadi- Boreya Road, the entrance wall had collapsed and a car parked there fell into pit in January 2023. The applicants including Rinki Yadav and others have demanded compliance of the order issued on July 13, 2023.
The single bench had also cancelled the order of the Municipal Commissioner to pass the map and the approved revised map by Ranchi Municipal Corporation under the Jharkhand Apartment Act- 2011. The land owner and builder VKS Reality was also instructed to fill the dug pit adjacent to the Ratan Heights Society within a month.
Talking to The Pioneer over the phone, Ajay Kumar a resident of Ratan Heights Society said that both the septic tank and rainwater harvesting tank are broken as well as the approach road is completely damaged. The High Court had ordered to stop the work, fill the pit, repair the road and give it to the society but they are not filling it and the apartment may collapse any time.
