The hearing of criminal appeal pending against the Indian officials and Union Carbide India Limited in the matter pertaining to Dec 84' Union Carbide disaster pending was listed for hearing in the Sessions Court from May 22 to 24, 2023.
The hearing will now take place on May 24 before the Bhopal, Principal District and Sessions Judge CBI Vs Warren Anderson in a significant seventh show cause notice has been issued for authorised representative of Dow Chemical's (Amy Wilson) attendance for October 3, 2023, following issuance of a ‘show cause notice’ in March by the First Class Magistrate Judge, Vidhan Maheshwari of Bhopal District Court.“As a direct result of Union Carbide’s 31 year refusal to face charges of culpable homicide and other serious offences, Dow has now been issued seven notices to appear in the Bhopal magistrate’s.
The US and India signed a 2001 Treaty to help each other pursue criminal cases. Under this treaty (MLAT) the US is meant to serve legal papers when India asks it to. But in the last six summons US Dept of Justice has put Dow’s interests ahead of its Treaty partner India.
Bhopal gas victims’ organisations are hopeful that US Dept of Justice will abide by the mutual treaty and will not protect the interests of Dow Chemical.
