Special Judge POCSO Act Kumudini Patel found the accused Kamal Singh and Bhavna Patel guilty of sexually assaulting a minor girl under Section 376 (2) L, F, 120-B IPC and Section 5L, N/6, 9N/10 POCSO Act and sentenced accused Kamal Singh to 20 years of rigorous imprisonment and a fine of Rs.1000 each under Section 376 (2) L and 376 (2) F IPC, 5L, N/6 and 9N/10 POCSO Act and sentenced accused Bhavna Patel to 20 years of rigorous imprisonment and a fine of Rs.1000 each under Section 376/120-B IPC and 5L, N/17 POCSO Act.

Special Public Prosecutors Divya Shukla and Jyoti Kujur presented the case on behalf of government.

On May 9 the victim lodged a complaint with Aishbagh police against her father's friend Kamal Singh whom she has known since childhood. Kamal Singh often visits her house. Kamal Singh is a resident of Gwalior, but whenever he came to Bhopal for his work, he used to stay at her house.

Kamal came to her house on November 4, 2017 and stayed at her house for about four months. On November 26, 2017 at around 7 in the evening, her father had gone to work and her brother was also not at home, then Kamal Singh started forcing himself on her and said, 'I like you and will marry you'.

At that time, the victim's mother, Bhawana, was sitting in front of her and when she tried to scream, Bhavana shut her mouth by putting her hands on the victim's mouth.

Fearing threats by the accused she never told this to anyone. Kamal sexually assaulted the victim many times in her own house and her mother, accused Bhavana, knew everything about this. She told her mother many times that she did not like it, then her mother said that nothing will happen, he will marry her.

On March 14, 2022, she came to her cousin's house and revealed the atrocity she faced and later a case was registered based on her complaint.

Agreeing with the evidence, arguments and documents of the prosecution, court sentenced accused Kamal Singh to 20 years of rigorous imprisonment and a fine of Rs.1,000 each under sections 376(2) L and 376 (2) F of the Indian Penal Code and 5L, N/6 and 9N/10 of the POCSO Act, and accused Bhavna Patel to 20 years of rigorous imprisonment and a fine of Rs.1,000 each under sections 376/120-B of the Indian Penal Code and 5L, N/17 of the POCSO Act.
