Despite legal victory from the highest court of the country, the fight of Ratan Heights, Morahabadi, residents is far from over. A 35-feet-deep pit still remains in the vicinity of Ratan Heights, posing a continuous threat to the safety of the residents. Despite several efforts by the residents and clear orders from both the High Court’s Single Bench and the LPA, the pit has not yet been filled by the builder or the landowner.
The residents continue to face this safety hazard daily, and the lack of compliance with the court orders remains a matter of grave concern.
The residents of Ratan Heights are hopeful that the authorities will take swift action to ensure compliance with the court orders and eliminate the ongoing safety risk. They remain steadfast in their commitment to pursuing justice and safeguarding their community.
The Supreme Court on September 06, 2024 dismissed the Special Leave Petition (SLP) filed by the landowners challenging the judgements of the Letters Patent Appeal (LPA) and the Single Bench of the Ranchi High Court. This dismissal marks a significant victory for the residents of the Ratan Heights building, who have been fighting a long legal battle for their rights.
The case in the Supreme Court was argued by Senior Advocate Tapesh Singh and Advocate-on-Record Prabhat Ranjan Raj on behalf of the residents of Ratan Heights. Their persistent efforts in presenting the case led to this favourable outcome for the residents, who have been dealing with various legal and safety concerns due to the ongoing dispute.
Initially, when the matter was in the control of the erstwhile society, under the secretaryship of Jaipuriar, they faced losses in the RMC Tribunal, RERA, and other forums. This series of defeats caused the residents to lose faith in the society’s ability & intent to represent their interests effectively. Consequently, the residents decided to take the matter into their own hands and pursued the case independently in the High Court and the Supreme Court, resulting in a significant victory.
