RERA orders full refund for Chintel buyer
The Real Estate Regulatory Authority (RERA), Gurugram, has granted major relief to Kumar Mangalam Dalmia, a homebuyer from Chintel Paradiso, Sector 109, by ordering a full refund of his investment along with compensation and interest.
Dalmia had approached the adjudicating officer at RERA Gurugram in 2023, seeking a refund of the principal amount paid for his flat in Tower H of the project, along with interest based on the current market value. He had purchased the unit from an original allottee but had not been offered possession until the time of filing the complaint. Chintel Paradiso came into national focus on February 10, 2022, after a tragic structural collapse in one of its towers, where 6–7 floors caved in sequentially. Following the incident, Dalmia—who had already paid more than the total sale consideration of Rs 1,00,38,750 under a construction-linked plan—opted to seek his money back.
After examining the case, the adjudicating officer ruled in Dalmia’s favour on merit. As per the order, the complainant is entitled to a refund of Rs 1,70,51,397, as assessed by a committee appointed by the District Magistrate. Additionally, RERA has awarded him Rs 2 lakh for mental agony and Rs 50,000 towards litigation expenses.
The authority further directed the developer to pay interest at 10.85 per cent per annum on the compensation amount, calculated from the date the DM-appointed committee assessed the valuation of Dalmia’s flat until full realisation of the dues.
The order brings a significant measure of relief to the complainant, who had been awaiting redressal following the 2022 structural failure that left several residents and homebuyers distressed.
