10 years’ RI to accused of minor’s abduction, rape

Special Judge, POCSO Act Rashmi Mishra sentenced 10  years' of rigrous imprisonment to accused who kidnapped and raped a minor girl.

The Special Judge, POCSO Act,  convicted Mahesh Ahirwar, the accused of rape, under sections 376, 366 of the Indian Penal Code and 5/6 of the POCSO Act.

Finding the accused guilty, a decision has been passed punishing the accused with 10 years rigorous imprisonment and a fine of Rs 5000 under Section 376 Indian Penal Code and 5/6 POCSO Act and 5 years rigorous imprisonment and a fine of Rs 1000 under Section 366 Indian Penal Code.

In the case, the government has been represented by Special Public Prosecutor  Divya Shukla and Jyoti Kujur.

In the incident on May 20, 2016, the father of the accused appeared at the police station Khajuri Road, Bhopal and lodged complaint about his missing minor daughter.

On the basis of the information regarding the incident, a missing person report was  registered by the police.

On June 4, 2016, police has booked the accused. After the verification victim revealed that Mahesh Ahirwar and she both are good friends and in May 2016 Mahesh took her with him to his home in Berasia district, Bhopal and he promised marriage but did not marry and accused Mahesh kept me with him for 15 days and sexually assaulted her many times without her consent.

The police registered case under section 363, 366, 376 (2) of Indian Penal Code 3/4 POCSO Act.

After completing the investigation, the charge sheet was presented before the  court.

Agreeing with the evidence, arguments and documents and scientific evidence of the prosecution, the  Court sentenced the accused Mahesh Ahirwar to 10 years of rigorous imprisonment under Section 376 of the Indian Penal Code and 5/6 POCSO Act and a fine of Rs 5000 and to 5 years of rigorous imprisonment under Section 366 of the Indian Penal Code. And the decision has been passed punishing him with a fine of Rs 1000.
