A day before Jharkhand Assembly readopted the bill related to the local policy based on the 1932-based khatiyan (land records) in the Assembly, Jamshedpur East independent MLA Saryu Roy, on Thursday made a personal resolution protecting the rights of people who have migrated to Jharkhand between 1932 and after the formation of Jharkhand in the year 2000.
Roy, in the form of a personal resolution, put forward a personal proposal for consideration in the House, on which Parliamentary Affairs Minister Alamgir Alam also replied. Roy said that the House pledges to the State Government that along with the inclusion of 1932 Khatian in determining the local policy in the state of Jharkhand, government should provide relief to the people of Jharkhand who were deprived of the 1932 Khatian. The consequences of the socio-economic-industrial and legal scenarios of the period between what he presented in the House, what he gave or suggested should also be considered and the points directed in the decisions related to this should be made a part of it.
Roy said that the provisions of the Bihar Reorganization Act-2000, the instructions prescribed in the decision of the five-judge division bench in Jharkhand High Court case no. WP(PIL)-4050/2002 and WP(PIL)-3912/2002 and R.I. The spirit of the 2007 judgment of the nine-judge Constitution Bench of the Hon'ble Supreme Court in the case of Kohle vs. Government of Tamil Nadu should be considered. If the local policy of Jharkhand to be made without this will not be in accordance with the relevant provisions of the Constitution, then like before, its rejection in judicial review will ultimately affect the future of the youth of the state and they will continue to be deprived of timely employment. He urged the government to consult the law department of the government on the legal aspects of their settlement and make it a part of the local policy. On this the Minister said that the local policy proposal has been passed in the House yesterday itself and has been sent to the Governor. On this, the Assembly Speaker said that his presentation was before the commencement of the House. On this, Saryu said that the local policy of yesterday (December 20) does not include the points of his proposal, rather the government has got the bill returned by the Governor exactly passed by the House. If this too is returned and the events and judicial decisions recorded in its composition between 1932 to 2000 and 2000 to 2023 are not included in it and the constitutional provisions are not complied with, then the youth of the state will remain deprived of employment for a long time.
After this, Minister Alam assured that he will inform them about the opinion of the Law Department in this regard. Saryu Roy has expressed hope that his presentation will bring a new turn in the redefinition of localism in Jharkhand. It will play an important role in making inclusive local policy in the state. The population of the state which was deprived of Khatian of 1932 and has settled in Jharkhand between 1932 and 2000 when Bihar was not divided, will also get protection.
