The decision of the Jharkhand Assembly Secretariat to allocate a room at the Jharkhand Assembly to offer namaz has been challenged before Jharkhand High Court.
A petitioner and right wing activist Bhairav Singh filed a PIL before Jharkhand High Court stating that the Assembly has violated the fundamental principle of secularism as enshrined in the Indian Constitution. The petitioner has said that the Assembly Speaker has no power to allocate any place at a government building to accommodate any faith.
He termed it as discrimination with followers of other religion who too are entitled for such provisions.
Senior Jharkhand High Court lawyer Rajiv Kumar who is counsel of the petitioner said that Jharkhand Assembly Speaker Rabindra Nath Mahto and the secretary of the Assembly have been respondents of this case.
Due to the decision the BJP in Opposition has stormed and disturbed the ongoing budget session of the assembly. From the past two days the BJP MLAs have been holding kirtan on the assembly premise. The BJP has also announced to gherao the Assembly on Wednesday.
For the connivance of Muslim MLAs and staffs of the assembly, a place is kept reserved on the assembly premise so that they offer namaz on the Friday during the ongoing session of the Assembly.
But never in the past was any official notification issued to dedicate any place for worship on the assembly premise.
Notably, the BJP MLA Biranchi Narayan too has shot a letter to assembly speaker to withdraw the decision else he will file a case before the court.
