Shah promises UCC in State, excludes tribal from its ambit

Union Home Minister Amit Shah today released BJP’s  Sankalp Patra during a public meeting in Ranchi stating party will implement Uniform Civil Code in the state and "drive out infiltrators" from Bangladesh.

“Hemant Babu, a Uniform Civil Code will certainly be implemented in Jharkhand, but the identity and heritage of the tribal communities will be fully preserved. Uniform Civil Code will be introduced in Jharkhand but the tribal community will be kept out of the ambit of the UCC," he said.

The BJP decision to introduce UCC in state and at the same time keep away tribals from its ambit assume importance as various Civil Right bodies and tribal organisation have been opposing the UCC in Jharkhand.  The proposal for the introduction of a uniform civil code (UCC) in the country has raised concerns among tribal and ethnic communities across India, with the leaders of many tribal bodies in Chhattisgarh, Madhya Pradhesh, Jharkhand and elsewhere issuing statements in protest. Their fear is that the UCC will infringe on their customary laws and socio-cultural practices, which enjoy constitutional safeguards.

Its primary objective is to establish uniformity in civil laws related to marriage, divorce, inheritance, adoption and other personal matters that are currently governed by separate laws for different religious communities. 

For instance, Adivasi communities from Jharkhand are concerned about the UCC replacing the Chota Nagpur Tenancy Act as well as the Santhal Parganas Tenancy Act, which explicitly protect their land rights by prohibiting the transfer of tribal land to married tribal women.

Union Home Minister statement to keep tribal out of ambit of UCC will give a message that their civil right will not be interfered.

The manifesto outlines 25 resolutions marking the state's 25th formation year. A major highlight includes the pledge to remove Bangladeshi infiltrators and return occupied lands to tribal communities. Taking aim at current Chief Minister Hemant Soren, Shah stated, "You have failed to provide security to the women of Jharkhand."

Union Home Minister Amit Shah making a scathing attack on the JMM-led government in Jharkhand, accusing it of "patronising Bangladeshi infiltrators for vote bank politics" and asserted that if the BJP was voted to power in the state, it will enact stringent legislation to prevent transfer of tribal land to illegal immigrants.

"Bangladeshi infiltration is causing a sharp decline in tribal population in Jharkhand, especially in Santhal Parganas and Kolhan regions... the JMM-Congress-RJD alliance is encouraging it for petty political gains," he alleged.

"Our 'Mati, Beti, Roti (land, daughter and bread) are under attack. The BJP will not allow this to continue...We will bring in stringent legislation to prevent the transfer of tribal land to infiltrators. We will also take back the land grabbed by them and drive them out," Shah asserted.
