HC seeks ED reply in bail plea filed by Soren in ‘land scam’

The Jharkhand High Court on May 28 directed the Enforcement Directorate (ED) to file a reply on the bail application moved by former Chief Minister Hemant Soren.

Hearing on the bail plea of jailed Hemant Soren was held today in Jharkhand High Court.   While hearing the case, the court asked the ED advocate to file the affidavit before June 10. Now the next hearing of this case will be on June 10. It is noteworthy that former Chief Minister Hemant Soren had filed a bail petition on Monday itself. And requested for hearing as soon as possible. Let us tell you that this hearing took place in the court of Justice Rangan Mukhopadhyay.

Hemant Soren has said in his petition that the allegation of land grabbing made against him by ED is completely baseless and baseless. 8.86 acres of Badgai land is land. Which cannot be transferred. He neither has ownership rights over the land nor is his name mentioned in any of the land documents. Despite this, ED has accused them of occupying that land.

Let us tell you that before this he had requested the civil court to grant him bail, but his petition was rejected. After this Hemant Soren reached Jharkhand High Court and said that the arrest made by ED is illegal. Jharkhand High Court had reserved the decision after hearing the case. Meanwhile, Hemant Soren reached the Supreme Court and requested for bail. After hearing the arguments of Hemant Soren's lawyer and ED's lawyer, the Supreme Court expressed displeasure that lawyer Kapil Sibal has hidden the facts related to the case. Therefore the judge said that he was going to dismiss the petition. On this, Kapil Sibal accepted his mistake and withdrew the petition.

In his petition, Soren pleaded before the court that his name does not figure in any of the documents about 8.5 acres of land in the Bargain circle and no offence under the Prevention of Money Laundering Act is made out against him.

He also claimed that the ED was relying only on statements of some people who had said that the land parcel belonged to him, but there was "no document to back such statements".

Soren had resigned as the chief minister before his arrest on January 31 and is now lodged in the Birsa Munda Jail at Hotwar in state capital Ranchi.

He was accused of being instrumental in tampering with land documents for a plot in Bargain in Ranchi.

Soren pleaded that the owner of the land was one Raj Kumar Pahan who had complained to the office of the Bargain Circle officer that his land was being encroached on by some persons.

Pahan had nowhere mentioned the name of Hemant Soren, yet the ED had brought about a case that the land was in the possession of Soren, the petition added.

Soren had on May 22 failed to get any relief from the Supreme Court which pulled him up for "suppressing material facts" in the plea against his arrest in the money laundering case linked to the alleged land scam.
