The double bench of Chief Justice of Madhya Pradesh High Court Justice Suresh Kumar and Justice Vivek Jain has sought a reply from the government as to why pensioners are not being given pension as per the sixth pay scale.
Madhya Pradesh Pensioners Welfare Association has filed this petition in the High Court. If this decision goes in favor of pensioners, then more than 3.5 lakh pensioner employees of Madhya Pradesh will get its benefit.
The Pensioners Association of Madhya Pradesh had filed a petition against the state government. In this petition, the Pensioners Association had demanded that they should be given pension as per the sixth pay scale.
In the petition, the Pay Revision Rules 2009 in the state have been challenged by the state president of Madhya Pradesh Pensioners Organization, Amod Saxena. There are about 3.5 lakh pensioner employees in Madhya Pradesh.
During the hearing on the petition, Senior Advocate K Gildiyal argued that in 2005, the Central Government had recommended the sixth pay scale, which was implemented in Uttar Pradesh and Chhattisgarh, but the sixth pay scale was not given to the employees in Madhya Pradesh.It has also been argued in the petition that in 2012 the then Chief Secretary had prepared the draft, but the government did not agree to it.
Therefore, the Pensioners Association had to bring this matter to the High Court. This petition is being heard continuously since 2018. The division bench of Chief Justice Suresh Kumar and Justice Vivek Kumar Jain of Madhya Pradesh High Court, while hearing this petition, has sought a reply from the state government in 4 weeks. Now, in this matter, the state government will give its reply in 4 weeks as to why it is not giving pension to the pensioners as per the sixth pay scale.
