Daylong training on changed new laws held at PTRI

We should know what changes have been made in the new laws, whenever we register a case or prepare a note sheet, we should know what kind of procedure should be adopted according to the new laws and which changed sections and procedures should be used said ADG Women Security Branch Shrivastava at one day training program organized by the Women Security Branch of State Police Headquarters at Police Transport Research Institute in Bhopal on July 12.

From July 1, the  Bharatiya Nyaya Sanhita  (BNS) has been implemented in place of the Indian Penal Code (IPC), Bharatiya Nagarik Suraksha Sanhita (BNSS) in place of the Criminal Procedure Code and the Bharatiya Sakshya Adhiniyam (BSA) in place of the Indian Evidence Act across the country.

A one-day training program was organized at the Police Transport and Research Institute in Bhopal regarding the new provisions of all these laws and the procedure to be adopted during investigation. In this program organized by the Women Security Branch, Police Headquarters on July 12, the chief guest, ADG Women Security Branch, Pragya Richa Srivastava, IG Himani Khanna and AIG Kiranlata Kerketta were present.

This training program will prove helpful in providing information about the new laws to the policemen.

The main speaker of the program and Law Officer AJK Vijay Bansal said that there were 511 sections in the IPC, which have been reduced to 358 in the Indian Judicial Code and all the definitions have been written in one place, 21 new crimes have been added in the BNS and the punishment limit has been increased to 41 crimes, 62 major changes have been made in the BNS. At the same time, all the crimes against women and children have been given place in Chapter-5.

He informed that earlier there were 484 sections in CrPC, which have been increased to 531 in the Bharatiya Nagarik Suraksha Sanhita   (BNSS). A total of 177 provisions have been changed in BNSS.

Along with 9 new sections, 39 new sub-sections have also been added and a total of 14 sections have been repealed and removed. Similarly, earlier there were 167 sections in the Evidence Act, which have been increased to 170 in the Indian Evidence Act. Also, 24 sections have been changed.

Strict laws have also been made for mob lynching while defining it. Now the punishment for this has been fixed up to death penalty or life imprisonment. Completely abolishing the treason law made by the British to protect their rule, the crime that harms the unity, integrity and sovereignty of 'India' instead of 'Government of India' has been declared as treason. Damaging any property of India and bombing outside the country will be considered a terrorist act.

The new law has duly defined terrorism and declared it a serious crime and has made provision for severe punishment. Digital and electronic records have also been included as documents. Video-audio recording of the search and seizure process has been made mandatory.

He said that in cases of punishment of more than 7 years, it is mandatory for a forensic expert to visit the crime scene for collecting forensic evidence.
