X user booked for lewd remark against Kirti Chakra awardee’s widow

The Delhi Police’s Intelligence Fusion and Strategic Operations (IFSO) cell has registered an FIR regarding an alleged lewd remark made about the widow of Kirti Chakra awardee Captain Anshuman Singh on the social media platform X.

A senior police on Saturday stated, “A complaint was received from National Commision of Women (NCW), alleging that a facebook profile has made extremely lewd and derogatory comment on a picture of a widow of a martyr, has committed the offence under section 79, BNS- 2023 and sec 67 of the IT Act, 2000.”

The NCW on Monday took a suo motu cognisance and filed a complaint before the Delhi Police regarding the matter. The commission also demanded a fair and timely investigation into the matter and requested a detailed action taken report (ATR) within three days.

Taking cognisance of the complaint and after preliminary examination of its contents, a case was registered under section 79 of Bharatiya Nyaya Sanhita (BNS) and sec 67 of the IT Act 2000 and investigation has been taken up

Section 79 of the BNS states “Whoever, intending to insult the modesty of any woman, utters any words, makes any sound or gesture, or exhibits any object in any form, intending that such word or sound shall be heard, or that such gesture or object shall be seen, by such woman, or intrudes upon the privacy of such woman, shall be punished with simple imprisonment for a term which may extend to three years, and also with fine.”

Section 67 of the IT Act, 2000 deals with the punishment for publishing or transmitting obscene material in electronic form. The social media platform has also been contacted to provide details about the handle that allegedly passed the lewd comments according to the officer.
