BMW hit-and-run case: Key accused sent to judicial custody till July 30

A Mumbai court on Tuesday remanded key accused in the sensational BMW hit-and–run case Mihir R. Shah in judicial custody till July 30.

At the end of her police remand, 24-year-old Mihir was produced before Chief Metropolitan Magistrate at Sewri S P Bhosale who sent him to judicial custody for 14 days.   On their part, the police sought the extension of Mihir’s custody. However, Mihir’s Advocates Ayush Pasbola and Shudir Bhardwaj opposed the extension of the police custody, saying the police had gathered whatever evidence that was required from the accused and that they had recorded the statements of 27 witnesses.

After hearing both sides, the court remanded the accused in judicial custody till July 30. 

It may be recalled that on July 7, a high-end BMW car allegedly driven by the Eknath Shinde-led Shiv Sena’s deputy leader Rajesh Shah’s inebriated son Mihir Shah knocked down a two-wheeler, killing a fisher woman and injuring her husband at Worli in south-central Mumbai in the early hours of July 7.

Mihir is being prosecuted under sections 105 (culpable homicide not amounting to murder), 281 (rash driving), 125B (causing grievous hurt), 238 (causing disappearance of evidence of offence, or giving false information to screen offender and Sections 184 (driving dangerously), 134A (not taking the injured to hospital), 134B (not informing the police) of newly-introduced Bharatiya Nyaya Sanhita (BNS) and 187 (punishment for offences related to accident) of the Motor Vehicle Act.

On the night of July 6, Mihir --after partying with his four friends and spending Rs 18,730 at a Juhu bar -- was driving his BMW when he rammed into a two-wheeler occupied by fish sellers -- Kaveri and his wife Pradik Nakva.

Kaveri and Pradik were returning from the Sassoon Dock at Colaba in south Mumbai after purchasing fish stock at an auction, which they sold at a local market. After being hit by the speeding car, the two were thrown into the air and they crash-landed on the bonnet of the SUV.
