FIRS against uknown persons

The Delhi Police has registered an FIR against unidentified persons in connection with removal of sensitive files and documents from the office of special secretary (vigilance) YVVJ Rajasekhar.

The alleged incident occurred on the intervening night of May 15-16, after Rajasekhar was discharged from his duties as special secretary (vigilance) by Vigilance Minister Saurabh Bharadwaj and the files and records at his disposal were to be handed over to another officer. 

Delhi police has registered an FIR under section 380/464/465/120B of Indian Penal Code 1860 against unidentified persons at IP Estate police station on Thursday on the basis of a complaint filed by Rajasekhar.

Bhardwaj, in a tweet, claimed Vigilance Secretary Suhdir Kumar had informed in a report to Chief Secretary Naresh Kumar on May 16 that “shadow files” of documents in Rajasekhar's office were created on his directions.  Sharing a portion of this purported report, the minister tweeted, “Mr Sudhir Kr, Sec Vigilance was appointed by LG not us. He had clearly written on 16.5.2023 to CS Mr Naresh Kr that shadow files were created on his directions. Nothing to do with Minister & it was in knowledge of his junior Mr Rajshekhar. Still false FIR against unknown?”

“Mr Rajshekhar in his note below accepts work was withdrawn from him,he sent 76 files to his boss. Why did he retain rest of the files ? Was it not illegal to retain files when work was withdrawn ? If files were tempered who tempered the files ? He and his boss should answer,” Bharadwaj said. In a related development, the Delhi government has taken cognisance of a complaint against Rajasekhar claiming he sought money from beneficiaries of compensatory jobs and will conduct an inquiry into the allegations.  The inquiry against Rajasekhar will be conducted by AV Premnath, who is currently under suspension in a criminal case.

As per the factual report , that sensitive records and vigilance matters involving inquiry into high profile individuals / officials, which are at different stages of inquiry, were alleged to have been removed from the office of Directorate of Vigilance.

 Rajasekhar was looking into sensitive matters including those related to the construction of Chief Minister Arvind Kejriwal's official residence and now-scrapped excise policy of the government, inquiry relating to Directorate of Information and Publicity payments, matters relating to Delhi Jal Board, Gold Theft Inquiry in Trade and Taxes Department, Nexus between Prison officials and Minister of Prison, Demolition of Heritage Structure by the then CEO, DJB and Feed Back Unit.

In the Factual Report submitted to his superiors, it was brought out that certain grounds were contrived to paralyze the ongoing inquiries and false note was generated by Minister, Saurabh Bhardwaj, alleging extortion racket against the Special Secretary looking into these inquiries and thereby divesting the said Special Secretary (Vigilance) of his work.  This was followed by breach/ trespassing into the room of Special Secretary (Vigilance) as per the directions of Minister, Saurabh Bhardwaj, during night hours of 15-16th May, 2023 for the purpose of tampering with the records with mala-fide intentions.

In his report,  Rajasekhar had said that he strongly objected to his room being opened and files removed on May 15 night.   Alleging that the documents were taken to a nearby room for photocopying, he had suspected “tampering” with records related to sensitive probes.

Thereafter, it was also informed in the Factual Report that in the name of an NGO, one Advocate submitted a complaint to Delhi Services Minister  Saurabh Bhardwaj, which was later on found to be false and fabricated.

 In the Factual Report it was submitted that the consequences of events clearly demonstrate that allegations made or contrived with design and ulterior motives by making forged/ false/ fabricated documents/ complaints on behalf of NGO who immediately submitted on 18.05.2023 that they never made such complaint.
