The Jharkhand High Court on Friday uploaded the order related to PIL filed by petitioner Shiv Shankar Sharma in which the petitioner had requested for a probe in the alleged shell companies owned by Chief Minister Hemant Soren.
The order was passed on April 22 by the bench of Chief Justice Dr Ravi Ranjan and Justice Sujit Narayan Prasad has ordered the Register of Companies to file a reply on the allegations made by the petitioner that the chief minister. The court listed this case for hearing on May 13 by the time the Register of Companies is expected to submit a reply.
“Let the Registrar of Companies-cum-Official Liquidator, Ministry of Corporate Affairs be implemented as party-respondent no. 14. Let Mr. Prashant Pallav, A.S.G.I. seek instructions from the Registrar of Companies regarding the Companies against which allegations have been made in this writ petition. Let the details of those Companies be furnished by the counsel appearing for the Registrar of the Companies to this Court,” the order stated.
After the order was passed by the court it was said that the court also gave a direction to the Enforcement Directorate (ED) to file a reply on the allegation. But the order doesn’t mention anything about the ED.
The ED has clarified that as per the order of the Jharkhand High Court, no any direction has been given to the ED.
“ED was made as respondent in this case by the petitioner but the court has not given any direction to us,” said sources in the ED.
Jharkhand Advocate General Rajiv Ranjan had particularly alleged that lawyer of the petitioner Rajiv Kumar was feeding wrong information to media and people that the ED too has been asked to investigate this matter.
He further said that an identical writ petition was dismissed with cost by the High Court filed by Rajiv Kumar and the matter went up to the Supreme Court, where also, the S.L.P. was dismissed. A similar petition was filed by one Indranil Sinha of Bokaro in 2013 (PIL) No. 4218 of 2013. The PIL was rejected and petitioner was fined with Rs 50000 as the cost of the case.
