Jharkhand Mukti Morcha (JMM), General Secretary Supriyo Bhattacharya and MLA Sudivya Kumar Sonu in a joint press conference said that BJP is spreading confusion on Chief Minister (CM), Hemant Soren's mine lease case.
Both the leaders said that BJP wants to destabilize the State Government, but plan of BJP will never succeed. They said that there is a court in the Country and JMM has full faith in the judicary. Sonu said that there is a need to look into every aspect in the mining lease case. In such cases the Government or anyone cannot be dismissed. For this, he cited three judgments of the Supreme Court (SC).
For the last two weeks, the politics of Jharkhand has been heated over the mine lease case of Chief Minister Hemant Soren. At present, the matter is with the Election Commission of India. Everyone's eyes are fixed on the decision of the commission, but the war of words between the ruling party and the opposition continues in the State. On the issue JMM leaders on Friday cited the earlier decision of the SC and said that the matter of mining lease does not fall in the supply of goods business.
The MLA said that in CVK Rao Vs Dattu Bhaskara-1964, a five-judge bench of the Supreme Court has clearly stated that the case of mining lease under Section 9 (a) of the Representation of the People Act, 1951 does not come under Supply of Goods Business. Similar judgments were given by the SC in 2001 in Kartar Singh Bhadana Vs Hari Singh Nalwa et al. The MLA said that under Section 9 (A) no person can be dismissed from his post in all kinds of cases. This can be done only in the use of supply of goods and government works. The issue of mine lease does not come into this.
He said that the Chief Minister has already mentioned in his election affidavit that a mine is on lease in his name, which he has sent for renewal. In this case, no criminal case is made out.
JMM leaders said that Babulal Marandi has become a self-styled judge. They said that in Jharkhand, they are roaming around demanding the resignation of Soren on moral grounds. They also said that till the year 2006, there was morality in Babulal but after that his morality ended. The people of Dhanwar had sent him to the assembly on the ticket of JVM, but keeping his morals at bay, he joined the BJP, they added.
Bhattacharya said that Raghubar Das is making unnecessarily hue and cry and he said that whether it is Meinhardt or Toffee-Biscuit case, investigation is going on in many such cases and very soon this will also come to the fore. He said that how many wrongdoings have happened during the tenure of Raghubar Das, all will come on the public platform very soon.
