One-time conversion fee breather for Delhi traders

In a big relief to lakhs of traders and shopkeepers, conversion charges on mixed land use and commercial streets would now be paid just one time instead of annually year after year.

The residential units in plotted colonies, which come under mixed land use or intended mixed land use category, would be required to pay a one-time registration fee. Besides, regulation charges ranging from Rs 588 per square metre (up to 50 yards plot) to Rs 4,200 per square metre (for categories A and B) for additional floor area ratio (FAR) will have to be paid by the owners of commercial establishments operating from residential areas.

With the consent of the Ministry of Housing and Urban Affairs, the Delhi Development Authority (DDA) has issued notification giving relief to shopkeepers and traders in the national Capital.

As per notification, the owners/residents and users of the premises under mixed land use shall be liable to pay one- time conversion charges on instead of annual charges. “Those who have made ‘one-time payment’ or where the amount already paid in installments is 1.25 times of the one-time payment or more will not be required to pay any further. Excess payment, if any, would be refunded. In case where full amount has not been paid as on the date of notification, the balance may be paid within 90 days of such notification,” the notification said.

“In case total FAR in the existing building is exceeding the permissible FAR on the plots size from 100 sqm to up to 250 sqm, such excess FAR (up to maximum 350 FAR) shall be permitted subject to payment of penalty charges amounting to 1.5 times the applicable charges. Any further delay thereafter will attract simple interest at the rate of 10 per cent per annum,” it said.

The authority has also decided to fix conversion charges of Rs 22,274 per square metre for upper floors of South Delhi’s markets — Sarojini Nagar, Khan Market and Green Park Extension. The old conversion charge stands at Rs 89,000 per sqm.

It is mandatory for users and owners to declare their properties under mixed land use and commercial streets. The violation would attract a penalty amounting to 1.5 times the one-time conversion charge for mixed land use.

The notification has come as a big relief to traders as an ongoing sealing drive initiated by a Supreme Court-monitored committee has shut shops of many business owners in various parts of Delhi, due to “non-payment” of conversion charges. Traders and shopkeepers in the national Capital have been demanding for one-time conversion charge for them.

For the residential properties or regularisation of unauthorised construction within permissible floor area ratio (FAR), the rate is fixed Rs 4,200 per sqm for colonies falling in A and B category; Rs 1,680 per sqm for C and D category; Rs 840 per sqm for colonies falling under E, F, G and H category. These rates would be applicable for only six months of notification. For local shopping centre, convenient shopping centre and shop-cum-residential complexes, the rate for additional FAR for commercial purposes is fixed at Rs 18,160 per sqm for A and B category of colonies; Rs 7,264 per sqm for C and D colonies and Rs 3,632 for E,F, G and H colonies.

“The rates for additional FAR would be applicable on the date of approval or sanction of building plans,” it said.
