Karnataka's new apartment law aims to strengthen homeowners' rights, says CM DK Shivakumar

Karnataka Chief Minister D.K. Shivakumar has said the proposed Karnataka Apartment (Ownership and Management) Bill, 2026 is designed to strengthen the legal rights of apartment owners and address long-standing issues faced by homebuyers.

The state government has invited suggestions from apartment owners, residents' associations, developers, and legal experts before finalising the legislation, with public consultations open until August 6.

According to CM Shivakumar, the draft law seeks to ensure that homeowners receive complete ownership rights after purchasing a property, including the smooth transfer of ownership documents and common areas.

He acknowledged that many apartment owners face difficulties during registration, possession, and documentation, and said the government aims to reduce disputes and improve transparency in the housing sector.

The proposed legislation is expected to replace two apartment-related laws that have been in force since 1972, creating a unified legal framework aligned with modern housing needs and the Real Estate (Regulation and Development) Act (RERA). The draft also includes provisions related to apartment management, redevelopment of ageing buildings, and dispute resolution.

Shivakumar said the government will consider feedback from all stakeholders before introducing the Bill in the state legislature, stressing that the objective is to protect the interests of lakhs of apartment owners across Karnataka.
