SC order shifts the spotlight on Banks

The Supreme Court has directed CBI to investigate the role/involvement of senior bank officials in sanctioning loans to the defaulting company in the matter of Reliance Communication Ltd.
The Supreme Court, in its order dated February 4, 2026, has directed the CBI to investigate the role of senior officials of the banks who had sanctioned loans to Reliance Communication Ltd. (RCOM).
The court, in its order, directed the CBI to investigate the conduct of the bank's authorities to determine whether the loans were released in collusion and connivance with the management of the defaulting company. According to sources, there were 14 Public Sector Banks who were part of the lenders’ consortium of Reliance Communication (RCOM). The SC categorically ordered the CBI to investigate whether bank officials acted in collusion, connivance or conspiracy with the company concerned while releasing financial assistance.
Emphasising the breadth of the investigative mandate, the Supreme Court categorically said that Section 17A of the Prevention of Corruption Act cannot be a deterrent in starting the investigation against the bank officials.
“It is imperative upon the CBI to investigate the conduct of the bank authorities to determine whether financial assistance was released in collusion and connivance with the management of the defaulter company.
In this vein, the reference by the CBI to Section 17A of the Prevention of Corruption Act is totally misconceived. We direct that, regardless of any such provision, the CBI must look into the nexus/collusion/connivance/ conspiracy, if any, and for that purpose, all lawful measures for taking the investigations to their logical conclusions must be adopted,” the Supreme Court said in the same order.
The judgment makes it clear that no statutory provision can be used to block or dilute an investigation into an alleged collusive linkage between banks and corporate entities. The Court has expressly directed the CBI to probe the conduct of bank authorities wherever the facts so warrant.
Authorising the adoption of all lawful and appropriate measures, the Supreme Court has instructed the CBI to carry the investigation to its logical and conclusive end. The ruling underscores that accountability of banks and public officials is paramount and integral to the integrity of the financial system.
The Court further observed that procedural technicalities cannot be permitted to shield financial misconduct, reiterating that investigations into serious financial irregularities must proceed independently, effectively and without impediment.
