LG reduces penalty of compulsory retirement on MCD teacher

Delhi Lt Governor Vinai Kumar Saxena has reduced the penalty of “compulsory retirement” imposed on an MCD teacher and diluted the same to “reduction by one stage in the time scale of pay for a period of one year without cumulative effect.”
Giving details, Raj Niwas said on Wednesday, the penalty was imposed by the MCD Commissioner in a matter of a domestic dispute case against the teacher by his wife. The LG reduced the penalty following an appeal by the teacher.
A case was registered against Vikram, MCD Teacher, by his wife, who lodged an FIR against him, alleging that he had beaten his son for not being able to recite mathematical tables and had acted violently when countered by his wife.
This FIR came after a prior complaint dated 2.4.2021, which was made by Vikram to the local police, wherein he has alleged harassment by his wife’s family members. The teacher was placed under deemed suspension wef. 12.4.2021 vide order dated 10.6.2021 consequent upon his arrest in case FIR no 95 dated 4.4.2021 registered against him in Police Station Sector-6, Bahadurgarh, Haryana.
Additional Sessions Judge court, Jhajjar, Haryana, in an order dated 19.2.2024 and 26.2.2024, acquitted him of all the grave charges and ultimately held him guilty only for a minor offence. The court refrained from awarding any substantive punishment and instead released him on probation for good conduct.
Saxena, while hearing the appeal of the Teacher opined that considering the limited nature of conviction, the mitigating circumstances noted by the Court and the fact that the incident arose out of a domestic dispute rather than any act involving moral depravity or corruption, the quantum of punishment, ie “Compulsory Retirement” imposed upon him appears excessive and disproportionate to the nature and gravity of the established misconduct.
Keeping in view, rule of justice, Saxena modified the penalty of “Compulsory Retirement” to “Reduction by one stage in the time scale of pay for a period of one year without cumulative effect”, giving relief to the MCD Teacher in the case.
