FIR filed after youth dies falling into open pit

Delhi Police have registered an FIR for culpable homicide against a private contractor and Delhi Jal Board (DJB) officials. This is in connection with the death of a 25-year-old motorcyclist who fell into an uncovered excavation pit in Janakpuri, West Delhi. Police said FIR No. 35/2026 is registered at Janakpuri police station under Section 105 of the Bharatiya Nyaya Sanhita (BNS). The investigation is being conducted with priority.
Police officials said strict legal action will be taken against those found responsible. The probe will focus on fixing accountability for alleged safety lapses at the construction site where the fatal accident occurred. “Responsibility will be determined after examining all aspects, including whether adequate barricading and warning signage were in place,” an officer said.
The FIR was registered after a PCR call was received at 8.03 am on Friday. The caller reported that a man had fallen into a nearly 15-foot-deep pit near B-3B, close to Andhra School, on Joginder Singh Marg.
A police team from Janakpuri police station, along with the SHO and inquiry officer, rushed to the spot. They found a man lying unconscious inside an excavated trench dug by the DJB. A motorcycle, an Apache bearing registration number DL 9SCJ 9478, was also found inside the pit.
With the help of the Delhi Fire Service, the man was pulled out and taken to Deen Dayal Upadhyay Hospital, Hari Nagar, where doctors declared him brought dead. He was later identified as Kamal Dhyani (25), a resident of Kailashpuri in Palam Colony. Preliminary inquiry revealed that Kamal was returning home from his office in Rohini, where he worked at a call centre of a private bank.
Police said a post-mortem examination has been conducted, and further legal action will depend on its findings and the outcome of the ongoing investigation.
Before the recovery of the body, the victim’s family had spent several hours searching for him through the night. According to police records, at around 1:35 a.m., Kamal’s brother, Karan Dhyani, along with some friends, reached the Vikaspuri police station to report that Kamal had not returned home and was untraceable. They were informed that there was no record of any accident, medico-legal case, or report linked to Kamal’s name or his motorcycle number. Kamal’s last phone call had been made from the District Centre area, and the family proceeded towards Janakpuri. At 2.50 am on February 6, Karan Dhyani formally reported his brother missing at the Janakpuri police station. The family met Sub Inspector Awant, who immediately began efforts to trace the missing man.
Police obtained Kamal’s mobile phone location, which showed his last position near Possangipur Park in Janakpuri. His details, photograph, and vehicle information were promptly circulated to the West District Control Room, SHOs’ groups, and the Janakpuri police station WhatsApp group to widen the search.
A search operation was carried out by police personnel along with family members. They searched the park area, nearby parking spaces, and surrounding colonies for several hours. However, neither Kamal nor his motorcycle could be located. It was only around 8 am that the PCR call regarding a man’s fall into an excavation pit on Joginder Singh Marg was received, leading to the grim discovery.
The incident has sparked serious questions over safety measures at construction sites in the city. Police said further details will be shared after additional inquiries are completed.
