Investigation reveals illegal detention of Himanshu

Video of  23-year-old Himanshu of January 7, 2025,who tragically died while in the custody of the Madhya Pradesh ATS in Gurugram, Haryana. A video showing him falling from the building has surfaced, and the ATS claims he jumped from the third floor of an OYO hotel, which led to his death.

However, a magisterial inquiry has raised significant doubts, revealing that Himanshu was illegally detained in the hotel room. The magistrate has criticized the illegal detention, deeming it a serious act of negligence. Additionally, the injuries on his body have been described as suspicious.

Based on the inquiry's findings, Sohna City Police Station has filed a murder case against nine Madhya Pradesh ATS officers. Himanshu's family maintains that he was murdered, and his body was thrown from the building.

Himanshu was arrested by the MP ATS on January 6 on charges of terror funding. After his arrest, he was taken to a hotel in Sohna City, Gurugram, where three other accused individuals were already being held. The following day, during interrogation, Himanshu allegedly jumped from the third-floor gallery, claiming he needed to go to the bathroom.

Typically, detainees are kept under strict surveillance, but Himanshu was able to open the balcony gate and jump. The key question remains: why did the ATS team not intervene to stop him?

CCTV footage from January 8 shows Himanshu falling from the hotel. The video shows a bike rider standing in the street when Himanshu falls behind him. The rider notices the fall but does not offer assistance. For the next 10 minutes, people walk by, but none attempt to help Himanshu.

On January 9, Himanshu's uncle filed a complaint against the MP ATS with Haryana Police, leading to the suspension of nine officers, including an inspector, head constable, and constable. Himanshu’s family asserts that he had spoken to his father a day before his death, suggesting he was alive and well before the incident.  Based on the investigation report, Sohna City Police Station has filed a murder case against nine Madhya Pradesh ATS officers. Himanshu's family alleges that he was murdered and his body was disposed of, rather than dying from a fall as claimed by the ATS.

On January 6, Himanshu, a 23-year-old from Madhepura, Bihar, was arrested by the MP ATS in Gurugram on charges of terror funding. He was subsequently taken to a hotel in Sohna City, Gurugram, where three other accused were already detained. The following day, Himanshu allegedly jumped from the third-floor gallery during an interrogation, claiming he needed to go to the bathroom.

Himanshu’s family states that he had spoken to his father a day before his death, fueling suspicions about the official account of his demise.

Himanshu’s brother, Sudhanshu, rejects the claim that his brother jumped from the third floor, insisting that he was murdered and that his body was disposed of. Sudhanshu further shared that he received a call on the evening of January 7, informing him that Himanshu had been arrested. He thought it was a minor issue, but later calls revealed that his brother had died. A photo showing blood on Himanshu’s head was also sent to the family, which prompted them to travel to Haryana.

The MP ATS team, led by Inspector Rahul Sharma, stayed in room 503 of a hotel near Sohna bus stand in Gurugram. According to ACP Abhilaksh Joshi of Sohna Sub-Division, the Madhya Pradesh police had not informed local authorities about their arrival or the arrest.
