Zubair Maulana acquitted due to police negligence

The notorious criminal Zubair alias Maulana was acquitted in the case of attempt to murder due to police negligence which was mentioned by the court as the shortcomings of the investigation in its decision.

It is said that the police could not gather technical evidence against the accused. At the same time, the complainant also refused to recognize him. There were allegations against Zubair for firing at a criminal from Bhopal on the night of September 2023 last year.

More than 40 cases are registered against criminal Zubair Maulana in Sehore, Bhopal and Indore.

In paragraph number 14 of the court order, it is written that the statements of the investigating officer in the context of the case were observed. During cross examination, the investigating officer has admitted that the mobile number of the complainant is not mentioned in the First Information Report (FIR). There is no mention of the number from which the complainant was threatened.

During the investigation, the investigating officer did not seize the mobile and SIM card of the complainant Nafees. Certificate under Section 63-B of the Evidence Act regarding call details was also not presented. In such a situation, the fact of Zubair Maulana threatening to kill the complainant by sending boys on mobile phone is not established.

It is mentioned in paragraph 15 of the order that the complainant Nafees alias Adalat himself has denied any incident being committed by Zuber Maulana.

Investigating officer Sub Inspector Kunwar Singh has also admitted in cross examination that during the investigation it was found that Zubair was not present there at the time of the incident. In such a situation, attempt to murder cannot be tried.

In the end, the court of District and Additional Sessions Judge, Fourth Additional Sessions Judge Chandrashekhar Jaiswal wrote in its decision that the investigators failed to prove the allegations leveled against the accused Zubair Maulana. In such a situation, Zubair Maulana was booked under section 294, 307/34. Is acquitted of charges under 120B and 427 of the IPC.

The incident is of September 2, 2023. Durga Nagar resident Nafees Khan alias Adalat had a dispute with vicious criminal Zubair Maulana over phone. The reason for this was that Nafees had called his aide Bablu and asked him not to invite his brother for gambling. After this, Zubair had threatened to kill Nafees over the phone.

After some time, at 12.15 in the night, on the instructions of Zubair, his associates Salman, Raja and his companions reached Nafees' house and opened fire on him. The bullet had passed over Nafees' head in the attack. A case was registered against Zubair Maulana, Salman, Raja and others under sections including attempt to murder.
