Patwari reaches HC on FIR against him, notice issued to Imarti Devi

Madhya pradesh High Court has serviced notice to BJP leader and former minister Imarti Devi, by accepting theplea of State Congress preident Jitu patwari for quashing the FIR lodged by her at Dabra police station in Gwalior.

Imarti Devi had lodged a complaint on the controversial remark on her by State Congress President Jitu Patwari.

He had filed a petition in the High Court challenging the police registering the case under other sections including the SC-ST Act.

While hearing the petition, a single bench of High Court Justice Sanjay Dwivedi has issued a notice to former minister Imarti Devi seeking her reply. The next hearing on the petition has been scheduled for July 2.

In the petition filed on behalf of petitioner Jitu Patwari, it was said that the statement he had given, in which he had not made any kind of caste based comment. Apart from this, there was no such intention, which has been mentioned in the FIR. Eight hours after giving the statement, he also publicly apologized. Hours after apologizing, an FIR was lodged against him. Not only this, complaints were also made in other police stations of the state. The FIR lodged is completely politically managed.Advocate Vibhor Khandelwal, appearing on behalf of the petitioner, told the single bench that an offense is not made out against the petitioner under the SC-ST Act, which is non-bailable. Other sections registered in the case are bailable.

In his statement, Patwari did not make caste based statements against anyone and did not make any indecent gestures, which has been mentioned in the FIR. A case has been registered against him under SC-ST Act on the basis of no evidence. After hearing the petition, the single bench has issued a notice to Anavedika Imarti Devi and sought her reply. The single bench has given freedom to the State Congress President to file a petition in the High Court for anticipatory bail against the registration of FIR.
