Row over Civil Judge appointment process

Row over age relaxation in Civil Judge (Junior Division) has started as candidates have demanded age relaxation for OBC, SC, ST candidates in the examination. The Jharkhand Public Service Commission (JPSC) will begin the application process for 138 posts of Civil Judge (Junior Division) from tomorrow, August 21. Candidates will be able to apply online through the official website at jpsc.gov.in. The last date for submission of applications is September 21 and the last date for payment of fees is September 27.

The recruitment drive is being conducted to fill 138 vacancies of Civil Judge (Junior Division). The candidate's age should be between the age of 22 to 35 years as on January 31.

Hazaribagh, Barhi resident and law student Sanjay Mehta, has written a letter to the Chief Minister Hemant Soren highlighting flaws in the recruitment examination advertisement of Civil Judge Junior Division. Mehta claimed that OBC have not received relaxation in age limit. Along with this, there has been a demand to change the cut off age limit to 2018 instead of 2023. Along with this, other demands have also been made in the letter.

Requesting CM Hemant Soren, he has said that advertisement 22/2023 has been issued by Jharkhand Public Service Commission. This advertisement has been issued for the regular appointment examination of Civil Judge (Junior Division) under Jharkhand Judicial Service.

Mehta claimed that so far Jharkhand Public Service Commission has conducted the Jharkhand Judicial Magistrate examination only four times under the Jharkhand Judicial Service. The first exam has been conducted in 2008, second exam in 2014, third exam in 2016 and fourth exam in 2018.

After 2018, now this exam is being conducted in 2023. In such a situation, it seems legally appropriate to give relaxation in age limit. Neighboring state of Bihar has conducted the Judicial Magistrate exam eight times since its separation from Jharkhand. Along with this, relaxation of five years in the age limit has also been given to ST, SC, OBC.

Sanjay Mehta has written that Section 85 of the Bihar State Reorganization Act 2000 has the power to adapt the statutes. And in section 86 there is a provision for the power of interpretation of laws. That is, the system of reservation and relaxation in age limit for ST, SC, OBC and women related to the recruitment of Judicial Magistrate in the state of Bihar. Same age limit and relaxation will be applicable in Jharkhand.

On the basis of facts, demands have also been placed on the government on behalf of lakhs of students. Demand has also been made to add the subject of CNT Act 1908 and SPT 1949 in the examination.

Candidates from the unreserved/BC/EBC/EWS category must pay a fee of ₹600, while those from the state of Jharkhand's SC/ST category must pay a fee of ₹150.

Candidates must be a Graduate in Law from a recognised Board/University. A candidate must also be enrolled as an advocate under The Advocates Act, 1961 till the last date of submission of the application form.
