SLP filed at Apex Court against Jharkhand HC judgment

The successful candidates of the 6th JPSC have filed a Special Leave Petition (SLP) before the Supreme Court against the judgment of Jharkhand High Court quashing the selection of 326 candidates. The petition was filed by one Faijan Sarwar.  Meanwhile, a caveat was also filed by one Mukesh Kumar at the Supreme Court who requested the apex court to hear them while hearing the said SLP.  The court is yet to fix a date for hearing. 

A double bench of Jharkhand High Court on Wednesday upheld the decision of the single judge to cancel the result of the 6th JPSC civil service examination in which 326 candidates were finally selected. The court passed the judgment while hearing a batch of petitions filed by Pradeep Ram, Shishir Tigga, Dilip Kumar and others.

The fate of these officers was hanging in the balance after the single bench of Justice Sanjay Kumar Dwivedi cancelled the entire recruitment on technical grounds.

The result was challenged on the ground that the qualifying mark of the qualifying subject (Hindi-English) was also added while preparing the merit list which was technically wrong.

Notably, in July last year, Jharkhand High Court had set aside the final result of the sixth civil service examination and directed the JPSC to submit the new merit list to the Jharkhand government. The court also directed the Jharkhand government to allocate cadre to the finally selected candidates as per the new merit list, within four weeks of JPSC submitting the merit list.

The single bench of Justice Sanjay Kumar Dwivedi passed the order while hearing a bunch of petitions as around 16 petitions were filed by candidates to challenge the JPSC result.

The court observed that the merit list is not in accordance with the established rules of the JPSC. The court pointed out that the qualifying mark of the qualifying subject (Hindi-English) was also added while preparing the merit list, whereas examination rules of the JPSC specifically ruled out qualifying marks can be counted in any way for the final selection.

The court observed that this is a case of gross misconduct that merit list was prepared by violating the law hence the JPSC and the competent authority must find out such persons take action and fix responsibility so that same is not repeated in the future.   

JPSC had declared the sixth JPSC civil service result on April 23 last year selecting a total of 326 candidates.
