Court of additional judge here at lucknow stress need of a probe by Economic Offence Wing (EOW)in connection with scam of Rs 1401.37 crore in the Rural Engineering Department (RED). However, no order has been passed in this regard as the court found it not competent to pass any such direction.
Social activists Nutan Thakur who went to court to seek a probe into alleged scam in the RED claimed that additional session judge, P N Srivastava, has observed while disposing of her plea that as per the CAG report, there is gross irregularities to the tune of Rs. 1401.37 crore in RED, hence it may be investigated by the Economic Offences Wing (EOW) of the State Government. She claimed that at the same time, since the judge cannot directly issue order in this regard to the government so it made just suggestions.
Nutan Thakur claimed to have challenged the order of Chief Judicial Magistrate (CJM), lucknow who dismissed her earlier petition for registration of case under section.156(3) CrPC saying that the petition was based on CAG report on which only the Central and State government can act and the subordinate courts do not have the authority to order registration of FIR on CAG report. As per the CJM, only the Central and State governments are empowered to act on CAG reports.
The matter concerns an irregularity worth nearly Rs 1401.37crore alleged to have done in RED for the years 2007-12 where all the standards, rules and regulations were badly flouted and thus huge financial irregularities were done resulting in heavy loss of government exchequer. In most cases, the tender rules were flouted and many irregularities were found during physical verifications. Nutan Thakur earlier also tried to lodge a case in this regard with the Gomti Nagar police station but after the local police and even the senior superintendent of police of lucknow refused to do so she moved to court to get a probe ordered in the multi-crore rupees scam.
