Supreme Court Urges Centre to Allow Abortion Beyond 20 Weeks for Rape Survivors

The Supreme Court of India has urged the Centre to consider amending existing abortion laws to allow rape survivors to terminate pregnancies beyond the current 20-week legal limit, stressing the immense trauma faced by victims.

Hearing a case involving a minor rape survivor, the apex court highlighted the physical and emotional suffering endured by victims, observing that forcing them to continue an unwanted pregnancy adds to their “pain and humiliation.”

The court questioned the rigidity of the current legal framework under the Medical Termination of Pregnancy (MTP) Act, which generally permits abortion up to 20 weeks, with limited extensions under specific conditions.

Emphasising a more humane and rights-based approach, the bench asked the government to re-examine the law in light of evolving societal realities and the need to protect survivors’ dignity and autonomy. It noted that in cases of rape, delays in reporting or discovering pregnancy often push victims beyond the legal gestation limit, leaving them with limited options.

The court also indicated that there should ideally be no rigid time limit in such cases, underlining that the law must adapt to ensure justice and relief for survivors.

The observations come amid a series of recent rulings where courts have permitted termination of advanced pregnancies, reinforcing that a woman’s reproductive choice is a fundamental right linked to dignity, privacy and personal liberty.

The matter has now placed the spotlight on possible reforms to India’s abortion laws, with the Centre expected to review whether broader exceptions should be introduced for rape survivors.
