CJP stir: Zero FIR on objectionable PM remarks moved to Delhi Police

A Zero FIR registered in Noida against a woman accused of raising objectionable slogans against Prime Minister Narendra Modi during the CJP-led protest at Jantar Mantar has been transferred to the Parliament Street police station in Delhi for further investigation.

Noida Police registered the FIR on July 29 following a complaint from a Supreme Court lawyer based in Noida. The complaint alleged that the woman used abusive language against the Prime Minister during the July 23 protest at Jantar Mantar over the NEET paper leak. As the incident occurred in Delhi, the case was filed as a Zero FIR and then transferred to Delhi Police, which has jurisdiction.

A senior Delhi Police officer said the force will review the contents of the transferred FIR, conduct internal consultations, and seek legal advice before determining the next steps in the investigation.

“The investigation will be conducted strictly in accordance with the law and all prescribed guidelines,” the officer said.

The complaint stated that the alleged remarks lowered the dignity of the Prime Minister’s office and could create enmity in society or disturb public peace. The case has been registered under Sections 352 (intentional insult to provoke breach of peace), 353(1) (public mischief), and 356(1) (criminal defamation) of the Bharatiya Nyaya Sanhita.

The complainant, Supreme Court lawyer Smriti Singh Chandel, said she decided to approach the police after coming across videos of the alleged slogans on social media. “I have filed a case against the girl who used abusive language against the Prime Minister and his late mother. My children are also on social media, and I don’t want them to hear or support such language,” Chandel said.

She said that while disagreements and protests are part of a democracy, abusive language should not be used against anyone. “We live in India and have been brought up with certain values. We should use simple and dignified language. Such vulgar and obscene words should not be used. You cannot insult anyone like this,” she said.

Police said further action will be taken after the Parliament Street Police reviews the complaint and supporting material submitted with the transferred FIR.
