When will UP Apartment Act come to fruition?

Inchoate laws have compromised interests of at least 5 lakh homebuyers in Noida

With the crisis of unauthorised construction looming large in Noida, the issue of delaying in implementation of the UP Apartment Act, 2010 has come to the fore. The Act was passed in the UP legislative Assembly during the Mayawati Government in the year 2010. Though the rules under the Act had been notified in the year 2011, local authorities have yet not implemented it in the region.

Noida Extension Flat Owners Welfare Association (NEFOWA) along with other associations who had earlier written to the UP Governor Bl Joshi to look in to the matter have written a letter to Rama Raman, chairman of all three authorities of Gautam Buddh Nagar and have asked him about the reason for delay in implementation. NEFOWA has also sought an explanation whether the Authority have followed the rules of the Act before approving the project. “Flat buyers of Apex and Ceyane towers in Emerald Court have already suffered due to an inchoate law. Non-implementation of the Act has compromised interests of at least 5 lakh homebuyers in the area,” said Indrish Gupta, an office bearer of NEFOWA.

In its board meeting in December last year, the Noida Authority had announced its plan to appoint a competent authority for implementing the Act. It had also said a detailed set of guidelines would be evolved.

The proposal, however, has seen no headway. “We had announced our move earlier and are working on it. Noida Authority approves projects by following rules and regulations. If any development takes place, it will be announced,” said Manoj Rai, OSD, Noida Authority.
