The Supreme Court has issued a notice to the Central Government considering a petition claiming the notifications given by the Government in December last year, on the implementation of the High Security Registration Plates (HSRP) scheme for affixation of Security Number Plates on motor vehicles to be against the orders of the court. The notice was issued on February 1 this year.
The Notifications passed by the Central Government amend Rule 50 of the Central Motor Vehicle Rules, 1989 and introduce the Motor Vehicles Order, 2018 replacing the old Motor Vehicles Order, 2001.
According to the petitioner, the said notifications are contrary to and therefore contemptuous of the Orders/Directions passed by the SC of India in various cases over a period of more than 10 years, alleged the petitioner in the court.
The petitioner further said that the government should be held in contempt for willfully disobeying the orders of the court. The SC, from time to time, has passed detailed directions to enable the statutory authorities to keep centralised control on the implementation of the HSRP scheme for affixation of Security Number Plates on motor vehicles.
Three orders dated December 8, 2011, February 7, 2012 and July 13, 2016 chronologically on the manufacturing, supplying and affixation of HSRP number plates.
Vikas Singh, Senior Advocate assisted by Naman Joshi, Advocate appeared on behalf of the Petitioner and alleged that the enforcement of the said Notifications will upset the entire HSRP Scheme as solidified by the Hon’ble Supreme Court.
The Bench comprising of Justice R Bhanumati and Justice R Subhash Reddy took cognizance and fixed the next date of hearing on February 8.
