The Delhi Police on Thursday said no criminal offence was noticed in the complaint by former BJP chief Vijender Gupta against Chief Minister Sheila Dikshit, seeking an FIR against her for alleged misuse of Rs 22.56-crore Government funds in a 2008 ad campaign.
"Since the allegations do not constitute a criminal offence, there is no basis for any investigation," noted a status report filed before Special Judge Narottam Kaushal. Gupta's counsel Ajay Burman, however, said the report does not show steps taken by the police on the complaint. The court directed the police to submit by August 17 a fresh status report.
To this, the court said, "I have also gone through the report. I am satisfied that the report does not disclose steps taken by the investigating agency."
It, then directed the police to submit by August 17 a fresh status report with regard to steps taken in pursuance of Gupta's complaint. Gupta had, in his complaint, sought registration of FIR for alleged criminal breach of trust (Section 409 IPC), criminal misappropriation of public funds and criminal misconduct under provisions of the Prevention of Corruption Act.
