Nirbhaya case: DCW issues notice to Tihar Jail over delay in execution of convicts

The Delhi Commission for Women (DCW) on Monday issued a notice on Monday to Tihar Jail authorities over "delay" in the execution of convicts of  Nirbhaya gang rape and murder on December 16, 2012.

In 2012, the country stepped on to the roads seeking justice for the 23 year old girl who was brutally gang raped and murdered by a group of men.

In May last year, the apex court convicted the four accused and passed an order confirming the death penalty to the four accused. However, the counsel of the three accused approached the court and filed a review petition and the Supreme Court in July this year rejected their petition.

"Two months have passed since their petition was rejected but the their execution has not taken place yet," said DCW Chairperson Swati Maliwal while issuing a notice to the Tihar Jail authorities. Maliwal further sought an explanation from the Director General of Tihar Jail over the "delay" in execution of these convicts.

"The authorities have been asked to inform whether an order authorizing the execution of the sentence of the death has been issued or not.Further, submit reasons, in case execution orders have not been issued. The authorities have been asked to submit reply by 15.09.2018," read the notice issued by the DCW chief.

Six men had assaulted the woman, who was later known as "Nirbhaya" (the fearless), and a male friend in a moving bus as it drove through the streets of New Delhi. After brutally gang-raped the 23 year old, the six accused men thrown her out of the bus near Munirka. She was so grievously injured that her insides were spilling out - along with her male friend near the airport. A fortnight later, on December 29, 2012, she succumbed in a Singapore hospital.

"Almost six years have passed since Nirbhaya was raped and murdered. The incident shook the entire country. Despite the entire country taking to the streets to protest the incident, crimes like rape have only increased since then. Our country's capital is today disgraced with having received the tag of 'Rape capital' of the world.  A major reason for such crimes to continue unabated is the lack of deterrence created by the system. There appears to be hardly any fear of law in the minds of the perpetrators," said Maliwal while issuing notice.

Further demanding justice to the parents of nirbhaya, Maliwal said, "It is crucial that the death sentence awarded to the rapists of the Nirbhaya is executed at the earliest in order to create a strong deterrence in the society.
