JJB denies bail to accused

The Juvenile Justice Board (JJB) on Friday rejected the bail application of the juvenile accused, who was arrested for killing his junior schoolmate seven-year-old Pradyuman Thakur on the school premises on September 8. The teen was sent to a Juvenile home after his arrest on November 8 and has been there since then. The teenager’s bail plea was moved by his counsel before the Board on Tuesday.

The Board also reserved its decision on whether the accused will be treated as a juvenile or an adult. The decision will be delivered on December 20. The next appearance of the juvenile is scheduled on the same day.

Besides, the sociological and psychological expert’s reports of the teenager were produced before the JJB on Friday. According to the sources, the Board noted that he was mature enough to recognise the consequences of his actions.

The report cited instances to establish that the accused had a hyper-aggressive streak to his personality and this also indicated that the teenager should be treated as an adult.

During the court proceeding, the concerned counsels were present before the Board. The bail order of the juvenile was announced around 5.15 pm by the Board. The arguments between the lawyers look almost three hours.

A heated argument took place between the counsels of the juvenile and the CBI lawyer during the proceeding. “All the concerned parties argued on the reports. Also, the contents of the reports are highly confidential and cannot be revealed at this stage. The Juvenile board will definitely note the contents of the report before reaching any conclusion whether the teen will be treated as an adult or not,” Varun Thakur’s lawyer Sushil Tekriwal said.

“The reports relate to the behavioural, sociological and psychological aspects of the juvenile. We have seen the reports and the contents of the report directly indicate that the juvenile should be treated as an adult and the matter should be referred in the child session court for further proceedings,” Tekriwal said. He also claimed that the report also indicated that the boy is not a normal child. “The conclusion of the report is sufficient that the teen should be treated as an adult and on the basis of the report, we have submitted our submission before the court that the juvenile should be tried as an adult,” Tekriwal said.

“We are hopeful that the court will pass an order that the accused teen should be treated as an adult and justice will deliver once the matter would be referred to the child session court for next proceedings,” he added

Apart from that Tanveer Ahmed Mir, the counsel of the accused teen, had left the court premises before the board delivered his verdict on the bail application of the teen. At the movement, Mir has denied saying anything to the waiting media persons.

Earlier, the Board had appointed a social committee and a clinical Psychiatrist of Rohtak medical college which had submitted their sociological and psychological reports before the Board.
