During the final arguments of the 2G spectrum allocation scam, Special Public Prosecutor Anand Grover said the entire process of spectrum licensing was arbitrary and Swan Telecom ltd and other accused firms were given unfair advantage.
The Swan Telecom promoter Shahid Balwa had prior knowledge of the design of the spectrum and he had kept the demand drafts and other things readied in advance.
Grover said Shahid Balwa and others who gained undue advantage in the spectrum also prepared the letter of intent in advance.
Anand Grover told special CBI judge OP Saini that Spice mobile also applied for the licensing for Delhi but got rejected.
“If chronological order was followed, then Swan telecom was at 5th number, neither chronological nor simultaneous order was followed during the allocation. No proper channel was followed during the allocation process, neither on the basis of date of
application nor on the basis of seniority.”
Stating that the entire process was arbitrary, Grover said, “Depending on somebody’s ability to run fast or walk fast, it cannot be decided whether to give them the spectrum license or not.”
Accusing A Raja, Grover said he rejected the then Union law Minister Hansraj Bharadwaj’s suggestion of referring the issue of spectrum allocation to the Group of Ministers (GOM). “He didn’t want any scrutiny from anyone else,” Grover said.
“Further, to assuage the then Prime Minister’s concerns over the issue, he (Raja) wrote a letter to him that he is prescribing with existing norms of first-come, first-serve policy and that he has also taken the concurrence of then solicitor general and Minister of External Affairs in this regard, which was not the case,” Grover claimed.
“He was the main conspirator. To favour the accused companies, first he changed the cut-off date for receiving applications from October 10, 2007 to October 1, 2007 for firms seeking 2G licences, in which out of 575 applicant companies, 408 applications were kept out of the race,” Grover told Special CBI Judge OP Saini.
The idea had already germinated that A Raja will favour someone else.
A Raja can do any mischief, he said.
