Gay sex: Police won't act till it gets plaint

In view of the Supreme Court order on gay rights issue, spelling out its stand on the issue of homosexuality, Delhi police on Thursday said that it can only intervene if it receives a complaint about a non-consensual encounter but it does not snoop into people’s private and personal affairs.

“Our position is very clear. Unless we get a complaint of anything non-consensual, this kind of sexual offence, we do not initiate legal action which has not been defined in section 377 of IPC,” said Joint Commissioner of Police (South-Western range) Tajendra luthra.

“It is only when somebody complains that we have to initiate the action. Otherwise, our legal position is very clear on if it is consensual, we do not snoop into people’s private and personal affairs,” he said.

In a big blow to the lGBT community, the Supreme Court had on Wednesday set aside the landmark High Court judgment decriminalising gay sex and threw the ball in  Parliament’s court for amending law. Amid the storm over the Supreme Court verdict on gay rights issue, Congress chief Sonia Gandhi and Rahul Gandhi also expressed disappointment over the order, signaling that Parliament would address the matter.

Meanwhile, in a statement issued by the Aam Aadmi party said it is disappointed with the judgement of the Supreme Court upholding the Section 377 of IPC and reversing the landmark judgement of the Delhi High Court onthe subject.

“The Supreme Court judgment thus criminalises the personal behavior of consenting adults. All those who are born with or choose a different sexual orientation would thus be placed at the mercy of the police. This not only violates the human rights of such individuals, but goes against the liberal values of our Constitution, and the spirit of our times,” it said adding that the party hopes and expects that the Supreme Court will review this judgement and that the Parliament will also step in to repeal this archaic law.
