The Allahabad High Court on Tuesday slapped a fine of Rs 15 lakh on a farmer who filed a writ petition for not being compensated by the local development authority for his 4.25 acre acquired for Ganga water project in Indirapuram, Ghaziabad.
The court’s order came after the farmer was found at fault for deliberately misleading the court about the compensation. The court was of the view that farmer was awarded compensation but he did not accept the said amount and filed a frivolous petiotion.
The Ghaziabad Develo-pment Authority (GDA) law Officer Rajendra Tyagi said Banasri Dass Kaushik, a farmer of Prahaladgarhi, filed a writ petition in Allahabad High Court in 1982 whose land was acquired by Avas Vikas Parishad for Ganga Water Project. The Avas Vikas Parishad handed over the total 50 acre to (GDA) for the Ganga Water Project in 1980. The farmer’s land in the entire project was measured at 4.25 acre in the entire 50 acre.
In his petition, the famer claimed that neither the Avas Vikas nor the GDA compensated him for acquiring his land in 1980. Taking a serious view of the farmer not being compensated during last 10 years, the High Court on last date had ordered the Principal Secretary Housing, GDA Vice Chairman and Commissioner Avas Vikas Parishad to appear in person.
The GDA on Tuesday made it clear before the High Court that the authority had compensated Avas Vikas Prishad with Rs 2.66 crore for the land. The farmer has no direct link with the authority. It was clash between Avas Vikas and the farmer.
The Avas Vikas Prishad made it clear that it had deposited the compensation amount of Rs 80 lakh for his land with the ADM (land Acquisition) but the farmer did not accept that amount and misled the court by hiding the fact.
After verifying the fact that farmer misled the court by hiding the vital facts, the High Court slapped a fine of Rs 15 lakh in its ordered passed on Tuesday morning added the law officer of GDA.
