Departmental proceeding initiated against DANICS officer by MHA

Ministry of Home Affairs (MHA) has initiated departmental proceedings against DANICS officer RK Gaur, currently posted with the Delhi Government. A vigilance enquiry has found Gaur guilty of facilitating purchase and transfer of a property in the name of his mother while holding the post of the New Delhi Municipal Council (NDMC) director in violation of the service rules.

The report said the MHA should initiate disciplinary action for major penalty proceedings against Gaur.

The MHA has initiated proceedings against Gaur after Ml Sharma, the Director (Vigilance) of NDMC submitted that a shop in Gole Market was purchased and transferred in the name of Gaur’s mother without the prior approval of the competent authority.

The Vigilance Director has sought action against Gaur and stated in his report that the matter was examined following various complaints received about unauthorised constructions and other violations in the NDMC area. As per CCS (conduct) rules, an officer should not use the office for his personal gains and profits.

The Vigilance Director’s report sent to the Union Territory section of the MHA stated , “During the examination of a case pertaining to Shop Number 44 in Gole Market, it was noticed  that the concerned dealing assistant Kishore Prasad, then NDMC deputy director Himanshu Ranjan and Gaur, who was then director (estate) had conspired and illegally regularized various violations without the approval of the competent authority  and thereafter facilitated purchase and transfer of the property in favour of  the officer’s mother”.

The report further stated that perusal of records has made it clear that Gaur not only misused his position as the Director, he had actively participated and accepted the application for transfer on partnership basis from his mother  and also accepted dissolution of the partnership in her favour.

The report also found two other NDMC officers for colluding with Gaur. “This act was aided and abetted by two other officers — Kishore Prasad and Himanshu Ranjan, whose cadre controlling authority is NDMC  and  Central Board of Excise and Customs (CBEC) respectively and action against them is being taken simultaneously.”

The vigilance enquiry also found that Gaur had wilfully misrepresented the facts while granting approval to regularize violations, accepting the dissolution of partnership in favour  of his mother. By doing so he misused his official position for personal gains in violation of  the Conduct Rules and proprieties, the report further stated.

Personnel Department records revealed that RK Gaur had declared late BD Sharma as his father. From the partnership and dissolution deed, it is noticed that Mishri Devi who is beneficiary in this case, is wife of late BD Sharma and hence mother of Gaur, the then Director of Estate who approved the transfer of licence for shop 44, Gole Market, Sharma noted in his report.
