The Delhi Police prepared a draft charge sheet in the February 9 incident where alleged anti-India slogans were raised in the Jawaharlal Nehru University (JNU) last year.
However, Special Commissioner of Police and Spokesperson, Depender Pathak said, “The investigation is yet to be completed. The Special Cell is yet to finalise the draft charge sheet.”
Police sources said that the charge sheet is with the top police officials of the Delhi Police. legal opinion is being undertaken on whether a final charge sheet is to be filed, sources said.
Anirban and Umar Khalid are likely to be named in the charge sheet which will be filed under the Sedition Act. Nine ‘outsiders’ have been identified. All of them are from Kashmir.
Among the nine names some are from other universities and some working are professionals. Though videos showed over 140 odd protesters only ‘nine’ have been identified, said sources. After assuring them that no legal action will be taken, their statements were recorded.
As per the police sources, the police failed to establish the role of Kanahiya Kumar, the then JNUSU president, to prove the sedition charges against him. However, sources say, Kanhaiya Kumar, who was the President of JNU Students Union then, did not stop the ‘event’ from happening. Delhi Police wants the court to take a call on whether he should face trial for framing of charges.
It may be recalled that on February 9 a protest was held in JNU against death sentence given to Afzal Guru and Maqbool Bhat.
Witnesses include JNU administration, JNU students affiliated with ABVP, students affiliated with Democratic Students Union and security guards. Also few students who were part of the Organising Committee have been made witness.
A clip aired on a national Hindi news channel has been found as not ‘tampered’ by CFSl. The hazy video shows students raising slogans and guards preventing rival group from a confrontation.
Another controversial video clip which purportedly showed Kanahiya raising anti-slogans, that later turned out to be fake, was not taken on record for investigation.
Kanahiya Kumar was first to be arrested. He was assaulted in court despite being produced under police protection. later Anirban and IJUmar Khalid had surrendered. All three are out on bail.
