The Delhi High Court, in a judgement, has held that Guru Gobind Singh Indraprastha University (GGSIPU) is not obliged to abide by the list of various castes/classes provided by the Central Government while admitting OBC students in postgraduate medical courses.

Justice VK Jain also said that the university is not established by the Central Government but is under an Act passed by the Delhi legislative Assembly. While dismissing the petition which demands reservation of candidates in the university only from the list issued by the Central Government and not by State Government, Justice Jain said, "There is no other statutory provision, which requires respondent (GGSIPU) to rely only upon the list of OBCs issued by the Central Government for the purpose of granting reservation in admission to PG Medical Courses. Consequently, there is no merit in the writ petition and the same is hereby dismissed."

According to the petition, filed by OBC aspirants, GGSIPU is a central educational institution and must follow only the Central Government-notified list of OBCs but it also follows the State list of castes while chalking out reservations for candidates. The petition contended that this practice reduced the chances of the petitioners' admission as the candidates outside the Central Government's list are also included. The petition, relying upon the university prospectus, said, "27 per cent seats for OBCs shall be reserved as per the guidelines of Government of India and OBC certificate from a Competent Authority as per central list of OBCs will have to be submitted by the candidate at the time of counseling."

It had also contended that three postgraduate institutes of medical education namely, RMl Hospital, Maulana Azad Medical College, Mahavir Vardhman Medical College and ESI Post Graduates Institute of Medical Sciences are of national importance and hence the university should abide by the Central Educational Institutions (Reservation in Admission) Act, 2006 and provide 27 per cent reservation to OBC candidates as per the Central Government's list of castes.
