'CBI's golf iron claim pure hypothesis'

Published on:

In the Aarushi-Hemraj twin homicide, the Talwars’ defence lawyer established the CBI’s murder weapon theory as ‘pure hypothesis’.

In his argument, Satyketu Singh said in all probable circumstances, the agency had surmised the two golf irons found wiped down were indeed the murder weapon. It was absurd to place such arguments before court since scientists picked holes in CBI’s assertion. When Dr MS Dahiya deposed, he observed on the basis of documents furnished by the CBI. Dr RK Sharma said on record that a battering from a golf iron gave one a depressed skull fracture whereas Aarushi had sustained a line fracture.

Secondly, the CBI did not adhere to rules by storing the seized articles in the treasury. No evidence of a treasury keeper was on record before court of law. The CBI had hence, violated rules and tampered with the evidence seals on a whim.

Thirdly, Dr MS Dahiya’s opinion, on whose basis the CBI stressed that the murder was committed using a golf iron, was based on documents furnished by the CBI. Dr Dahiya personally never inspected the crime scene, which he had stated before the court.

Fourthly, the closure report had already mentioned there was no corroboration in the sequence. The CBI’s theory of the use of golf iron in the crime was assumption marked by illegalities and lapses.
