In Aarushi-Hemraj double murder case, a local CBI court has rejected application filed by Rajesh and Nupur Talwar for the adjournment of proceedings for recording their statement under Section 313 of CrPC.

Rejecting the plea, special judge S lal stated that after completion of the testimonies of the prosecution witnesses the trial should be initiated on the day-to-day basis.

"There is no merit in Talwars' application and so their plea for adjournment is rejected. The accused are to be summoned for recording their statements under Section 313 of CrPC on May 10," the court said. In its primary observations the judge mentioned that the testimonies of the prosecution evidences were completed on April 24, 2013 but the accused filed application for summoning of 13 other witnesses which were included in the original list.

In its seven-page order rejecting the Talwars' plea to summon 13 CBI officials as witnesses, the court observed that the prosecution had produced reliable witnesses. "That is their right upon whom to produce and whom not to produce before the court. The court cannot force them," the order read. When their request was rejected, they filed another application for the adjournment of the proceedings of recording their statement under section 313 of Cr.PC. In their application, Talwars mentioned that they had filed SlP in the Supreme Court of India against the court order rejecting the summoning of 13 other witnesses.
