Bhushan-Mulayam CD positive: Police

In a setback to former law Minister and senior advocate Shanti Bhushan, Delhi Police sources on Monday claimed that the report pertaining to CD having conversation of Bhushan with Samajwadi Party Chief Mulayam Singh Yadav and former SP leader Amar Singh is 'positive'.

The voice samples of trio were sent to the Central Forensic Science laboratory (CFSl) of Delhi for the examination. Based on the report from CFSl, the sleuths of special cell are now seeking opinion of legal experts to contemplate legal action against Bhushan.

The 'fake' CD surfaced in 2011 in which Shanti Bhushan is reportedly telling SP leader Mulayam Singh Yadav that his lawyer-son Prashant Bhushan could fix a judge for a 'fee'. later, senior Bhushan had approached Delhi Police claiming that the CD was sent to him by an unknown person.

"The CFSl of CBI sent voice samples' report to Delhi Police in May following examination confirming that the voices on the CD were of Bhushan, Mulayam Singh and Amar Singh. The CD is not fabricated, as claimed by Shanti Bhushan. After receiving the report, the sleuths of the special informed the Special commissioner (special cell) S N Srivastava who in turn informed the Delhi Police Commissioner Neeraj Kumar. Senior officials are now in touch with the legal experts and planning to file a fresh case against Shanti Bhushan under sections of Prevention of Corruption Act," the sources added.

The special cell of Delhi police had in October last year taken the voice samples of Mulayam Singh Yadav in the Bhushan CD case while voice samples of Amar Singh and Bhushan had been taken previously.

It may be recalled that Shanti Bhushan had claimed that the CD in question was fabricated by vested interests to malign his image. "It has been mentioned in the CFSl report that Shanti Bhushan was first introduced by Amar Singh to former UP Chief Minister Mulayam Singh Yadav. The conversation is about managing a Chief Justice of Andhra Pradesh High court and they were talking about Rs four crore," the sources said.

Delhi Police had earlier filed a 'closure report' after claiming that CD was original, but court had rejected the closure report and directed the investigating officer to re-investigate the case after which 120-B (criminal conspiracy) section was added in the existing FIR. The court had stated in its order that "The prosecuting agency clearly failed to investigate as to what the motive of creating such a CD. Was it to malign the complainant (Shanti Bhushan) and in turn thwart the civil society movement on the lokpal Bill, which he had undertaken or was it a ploy to make the Supreme court judge to recuse himself from the Bench which was hearing 2G caseIJ"
