AIIMS chief fails to produce papers before CAT

AIIMS director MC Misra has failed to produce even a single document in a reply to the Central Administrative Tribunal (CAT) on the plea by ex-CVO of the institute Sanjiv Chaturvedi who demanded for the allocation of work against the post of Deputy Secretary at AIIMS.

Besides, the director has allegedly made a few more false statements before the CAT in this matter, according to sources. On June 23, 2011, the director had passed the order regarding work allocation to the post of Deputy Secretary and the same has been implemented in “letter and spirit”. However, it was a mere statement as nothing of the sort was implemented by the director.

According to the director’s affidavit filed in reply to the CAT, there is no mention of the allocation of the concerned work to the Chaturvedi for the post of deputy secretary. But, it has mentioned a few more false statements and that amounts to committing perjury to the court. It said, “The two PIls have been filed in Delhi High court with regard to work allocations of the applicant and court has agreed to hear two PIls together and regular hearing s are being held.” A copy of affidavit is with The Pioneer.

“The two PIls filed in the High Court are not for the work allocation to the depurty secretary’s post. Hearing for one PIl is scheduled for 10 December and other is for 27 November”, said the Magsaysay awardee in his counter reply.

“The other false statement director’s affidavit contains is that “during the period July 2014 to August 2015, the performance of the applicant was rated as outstanding but it was not accepted by the competent authority.”

“It is a matter of on record that it was not only accepted by the competent authority but also conveyed/disclosed to the applicant after which the process attained finality” mentioned Chaturvedi. Even, The Standing Finance Committee, 195th governing body of the institute says to allocate the charge of CVO to the officer on the post of DS.

However, when Misra was contacted to take his version in this regard, he refused talking on legal matter. Commenting on the issue, AIIMS spokesperson Amit Gupta said: “It is a sub-judice matter, let the court decide what is wrong and what is right. At the end, the final judgment will be given by the court.”

In June 23, 2011, the Health Ministry issued the orders which said, the job description for the post of deputy secretary has the task of monitoring and supervision of infrastructure projects going on in the institute, management and control of the institute and coordination with multi-disciplinary experts.

According to his petition, this all is being done to protect the large scale corruption undergoing in the institute.”When Chaturvedi was CVO, he unearthed many irregularities in the AIIMS administration.”

It has been three years since Chaturvedi has joined and till now, he has not been allotted the assigned duties according to the post. Even, the Parliament Standing Committee report of AIIMS stated on August 11 noted that of the five projects (both completed and on-going) of Oversight Committee costing Rs615.87crore have witnessed time overruns and cost escalations.

Similarly, of the 23 other projects (both projects and on-going) most of the projects have lagged behind their set targets and thus have not met time and cost deadlines. The committee feels that thus a ‘pathetic situation’ as such delay does not bode well for an institution of vital importance like AIIMS. The committee has sought the response from AIIMS regarding the delays and cost escalations.

“The court has given 2nd November’s deadline to the director, to state the reasons of the false statement or else it will start the perjury proceeding against the director.”
