After Juvenile Board, Sessions court junks bail plea of accused

The bail application of the 16-year-old accused of killing a seven-year-old boy at a private school in Gurugram’s Bhondsi area was rejected by the Sessions court on Monday. Earlier on October 30, the Juvenile Board had also rejected the teenager bail plea.

The bail plea was moved before the court of Additional Sessions Judge Jasbir Singh Kundu who rejected the same and asserted that there was no ground at this stage to release him on bail.

The accused is lodged at the correction home in Faridabad since November 11 after the Central Bureau of Investigation (CBI) nabbed him on November 7 on charges of murdering the Class 2 student of the school. The CBI lawyer and the counsel for the seven-year-old victim argued that granting bail to the accused would be detrimental to the case.

The CBI in their reply asserted that in case Bholu petitioner (imaginary name given by the trial court) is granted bail he may tamper with the prosecution evidence and also influence the prosecution witness. The agency also mentioned that he may abscond which would hamper the course of the trial so the bail plea should be dismissed.

The accused sought regular bail saying that he had no criminal background. He also said that the Juvenile Justice Board has wrongly passed the order that he be tried as an adult in the murder case without taking into consideration that the accused is a student and his whole educational career is at stake.

The defence lawyer in the bail application also argued that the teenager has spent almost a year in the correction home and there no other

concrete matter is available in the case. The bail plea also said that the teen’s parents are ready to abide by the condition imposed by the court for granting bail.

The schoolboy was found with his throat slit outside a school toilet on September 8 last year. Earlier, the court had barred the media from using the name of the 16-year-old accused in the case and asked it to use fictitious names instead. While the seven-year-old victim was named “Prince” by the court, the juvenile accused was named “Bholu” and the private school in Bhondsi was referred to as “Vidyalaya”.
