ACB chief threatens to sue Kejriwal, raps 'false' memo

In a strong rebuttal to the memorandum issued against him, Joint Commissioner of Police and Chief of Anti-Corruption Branch (ACB) Mukesh Kumar Meena threatened to sue the Chief Minister. Meena shot off a letter to the Chief Minister warning him of legal actions unless the Government withdrew the memorandum.

Refuting on the memorandum that seeks ACB chief to reply back in his defense within 10 days, on the allegations of negligence of his duty and intimidating his juniors, Meena has sent a preliminary response to Kejriwal. Through his letter, Meena has mentioned that he is an IPS officer and a member of All Indian services and the only competent authority to institute any proceedings against him happens to be the President of India, i.e. Central Government.

Calling the memorandum as ‘illegal’ and ‘false’ Meena trashed the charges and accused Kejriwal of overreaching his jurisdiction since he is not the competent authority to issue such a memorandum. ACB chief has demanded the withdrawal of the memorandum, failing which he will initiate legal actions against Kejriwal and his government.

Meena, seems to be foaming at mouth, wrote that the Rule 7 of the All Indian Services (Discipline and Appeal) Rules, 1969 defines the “authority” (Central Government) to institute any proceedings against him.

Joint CP, seemingly reminded Delhi CM about the violation of the former’s fundamental rights and has written in a hardening tone, “The issuance of the memorandum by the incompetent authority is violation of the fundamental rights enumerated in Part-III (Fundamental Rights) of the Indian Constitution.”

Meena wrote, “My terms and conditions of the service are governed by All Indian Services (Discipline and Appeal) Rules, 1969.” Dismissing the memorandum issued against him by Delhi Government, Meena wrote, “Under the said rules, the only competent authority with regard to any disciplinary proceedings against me is the central government and not the Government of NCT.”  Notably, Meena was initially threatened with an inquiry by Delhi Government that passed a memorandum against him.
