AAP MlAs allege undeclared Emergency in city

Claiming that an undeclared Emergency has been imposed in Delhi and warning the Central Government not to think of indulging in any adventures of the likes of imposing President’s Rule in Delhi, the Delhi Assembly on Friday passed a resolution asking the Government of India to make necessary amendments to the Constitution to prevent an Emergency-like situation in the future.“In view of the possibilities of Emergency-like situation in the present scenario even after a long period of independence, this House resolves that the Government of India should take appropriate steps for strengthening the federal structure and democratic setup by making necessary amendments to the Constitution to prevent such situation,” reads a private member resolution cleared by House through a voice vote after a detailed discussion.

While moving the Resolution, AAP MlA from Rajouri Garden Jarnail Singh said, “If the Central Government is under the impression that they can venture on an adventure like dissolving the Assembly, I must remind them that in the SR Bommai versus Union of India case, the Supreme Court has ruled that the courts can review such a proclamation and declare it void if it is found to be malafide. And not only that, the courts can even restore the dismissed Government to office and revive the Assembly.”

AAP MlA Sarita Gupta, while supporting the resolution, said that the Central Government has imposed an undeclared Emergency on the State and is not allowing the elected Government to function through various means. In response, BJP MlA and leader of Opposition Vijender Gupta said that the Delhi Government violates laws, murders democracy, insults officials in public and then moves such resolution and makes such speeches in the Assembly.“We are discussing Emergency in these walls when a kind of Emergency never seen in 66 years of Independence is being observed in this very House. When the Opposition raises its justified voice demanding the CM to respond to fake degree case of one of his former Ministers, the Speaker says that the matter is subjudice,” he said.

“later, in this very House, when the membership of 21 MlAs is in danger for holding offices of profit, the matter for which is also subjudice and listed for hearing on July 1, then on that subjudice matter, an Office of Profit Bill is tabled in the House. The Opposition is thrown out by the marshals and the Bill is passed without any discussion whatsoever. No MlA from the ruling party stands up to speak because for them whatever is written, they have to go by that. Isn’t this a state of EmergencyIJ” asked Gupta. He added that nowhere else such an anarchist Government has ever held office in the history.despite opposition by the BJP MlAs, the resolution was later passed through a voice vote.
