A legal mousetrap?

Taking a stern view of the misuse of laws related to crimes against women, a Delhi court has observed that such defiance needs to be checked as it affects the cause of genuine cases. The court made the observation while dealing with the bail application of a man, accused in a rape case, in which he claimed that he was implicated by a gang involved in extortion business and the woman has lodged similar cases against 10 people in the same police station.

Additional Sessions Judge Kamini lau said if allegations made by the man regarding the complainant — being a member of a gang involved in extortion activities like laying honeytraps and filing false cases — is correct “then it is a serious matter, which should have been looked and inquired into at a district level so as to rule out the connivance at local level”.

“Any abuse and misuse of laws relating to crime against women by a group for attaining their nefarious ends needs to be checked for it dilutes the cause in genuine cases,” the court said.

It also directed that a senior police official, not below the rank of Deputy Commissioner of Police (DCP), would appear before it on the next date of hearing on July 9, along with detailed status report on the probe being carried out in the FIRs lodged by the alleged victim against others.

“Keeping in view the seriousness of allegations involved, I direct the personal appearance of senior officer not less than the rank of DCP before this court on the next date, along with the detailed status of investigations in the FIRs (lodged by the woman against other persons),” the judge said.

The court said that the DCP should inform it if any inquiry has been conducted at his level on the allegations made by the father of accused Narender Pal Kashyap against Ravinder Thakur of running an organised gang engaged in framing people in cases of rape, molestation, attempt to kill or criminal intimidation lodged to attain nefarious ends.

Kashyap, who is facing prosecution in a case of rape and criminal intimidation lodged last year, provided the details of 10 cases which have been registered by the woman against other persons in the Vijay Vihar police station.

The court said that the status report submitted by the investigating officer regarding the probe into the FIRs lodged by the complainant was “half-hearted”. It added that station house officer (SHO) of Vijay Vihar police station was not present to assist the court as to why detailed status of probe in these 10 cases has not been placed before it. The court has now fixed the bail application for further arguments on July 9.

The court directed that a copy of its order be placed before the Joint Commissioner of Police with the directions to ensure presence of senior officer of North-West Delhi district before it along with details of the probe. During the arguments on bail plea, the accused had claimed that even the DNA report did not support the allegation of the woman that she was raped by him.
