Govt pleads with l-G 2nd time to ask ACB to give panel papers

Staff Reporter

After the appointment of Commission of Enquiry chairman Justice (retired) SN Aggarwal to probe the CNG Fitness scam, the AAP Government has once again requested lieutenant-Governor Najeeb Jung to direct Anti-Corruption Branch chief Joint Commissioner of Police Mukesh Kumar Meena to provide Aggarwal all the relevant records so that he could initiate the proceedings in the matter.

Justice (retired) Aggarwal has told the l-G that he is “undermining” his own position by following Centre’s instruction with regard to the validity of probe panel.

Responding to the l-G’s reply to his earlier letter in which he had turned down his request to assist him in providing relevant documents related to the Fitness scam,  Justice (retired) Aggarwal has reiterated that the issue of validity or invalidity of the Commission was pending before the Delhi High Court where a prayer for staying the proceedings of the Commission had been declined.

In his reply to the l-G, Justice (retired) Aggarwal said, “The court did not restrain the Commission from functioning. It merely directed that the Commission shall not pass any coercive orders. In keeping with the orders of the High Court, I had requested you through my communication dated December 30, 2015, to direct MK Meena, Joint CP, ACB to produce the relevant record pertaining to the subject matter of the inquiry which unfortunately you have declined.”

The l-G had written to Justice (retired) Aggarwal  that the Union Home Ministry had declared  the Commission legally invalid  and therefore void ab initio. The l-G said he  was Constitutionally bound to follow instructions of the Union Home Ministry and was therefore unable to assist him  in the  matter.
